WASHINGTON ? Fueled by the Supreme Court decision upholding Obama?Care ? on the basis that the penalty for not buying health insurance is a legal tax ? Mitt Romney?s allies are launching a tax attack against the president.
They quickly found that proverbial silver lining in the cloud after the Thursday Supreme Court ruling handed President Barack Obama a big victory for his signature Affordable Care Act.
?President Obama breaks another promise,? is the tag line of an ad to start running Saturday on national cable television from the pro-Romney American Crossroads SuperPAC. The spot uses video from a 2008 campaign event where Barack Obama pledges not to raise taxes on people making less than $250,000.
In a conference call with reporters Friday organized by the Republican National Committee. Louisiana Gov. Bobby Jindal slammed Obama for breaking his tax pledge.
?I was very disappointed in the ruling, but I do congratulate the Supreme Court on one thing: They were a lot more honest about ObamaCare than President Obama has been. They have rightly called it what it is ? a tax,? Jindal said.
Obama deputy campaign manager Stephanie Cutter said in rebuttal, ?Already, Mitt Romney and Republicans are out with outright falsehoods about ObamaCare ? their favorite distortion being that this is somehow a broad tax on the middle class.
?In reality, this is all about personal responsibility ? and the ?tax? they are trying to scare everyone about is actually a penalty for the 1 percent of people who can afford insurance but still choose not to buy it, leaving the rest of us to pay for their health care when they head to the emergency room,? she said.
? What?s new: Jindal is one of many GOP voices jumping on the Supreme Court ruling, authored by Chief Justice John Roberts, that said the individual mandate to buy health insurance ? or pay a tax (a k a penalty to Obama, et al) is legal. Though Republicans were disappointed with the decision, they realized they had two new fronts from which to attack Obama: He broke his basic tax pledge and he misled the public in selling his health-care plan by denying the penalty was a tax.
? Obama?s new chore: Yes, the penalty for not buying health insurance starting in 2014 is a tax. Yes, the Obama team has explaining to do about how Obama, who taught constitutional law, could have been so certain in stating the penalty was not a tax ? only to have his law saved because his government lawyer sold the tax defense to Roberts.
? But is it a tax increase? The answer depends on what part of a person?s tax picture you are considering. Under Obama, for example, everyone who gets a paycheck has been paying less Social Security payroll taxes in 2011 and 2012. If you make $106,800 a year, you are keeping $2,136 more of your own money. And if you have health insurance ? or will be able to obtain it or afford it because of ObamaCare ? you won?t be paying any penalty (a k a tax).

Freeloaders resurface as an issue: Obama and his allies have been noting for years ? and were repeating at week?s end ? that people who don?t have health insurance ? and can afford it ? are freeloaders and cost shifters. People pay more taxes and higher insurance premiums to health providers to cover the costs for treating people who choose not to be personally responsible and by choice do not get health insurance. Is pressuring people to buy health insurance really a tax increase? Or is it a move toward tax equality?
? Mitt?s Massachusetts plan: Watch for even more praise from the Obama team for Romney?s individual mandate in the Massachusetts health-care plan, which he signed as governor. ?ObamaCare, modeled on Romneycare,? was a headline on an Obama campaign memo sent out on Friday. You will hear more of this: The Romney health plan includes a penalty for people who declined to purchase health insurance.

Nothing in Thursday?s U.S. Supreme Court ruling is expected to keep Minnesota from moving forward with its own health insurance exchange, according to key lawmakers, state officials and interest groups.
Health insurance exchanges allow some uninsured individuals and small groups to shop for a variety of tailored health coverage plans. The exchanges, typically online, have been compared to travel websites like Orbitz or Expedia, and advocates say they will help lower coverage prices.
Although about 15 states already have implemented exchanges, the issue has been extremely divisive in Minnesota. Gov. Mark Dayton?s administration began preparations for an exchange in 2011 without input from the Republican legislative majorities.
In an open letter to Minnesotans on June 21, a group of lawmakers and agency officials who are working with Dayton on the health insurance exchange promised to build on successes in the state while evaluating health care innovations in the future.
The letter (PDF) highlights Minnesota?s longtime leadership in health care initiatives and reform and calls for bipartisan solutions to the problems that still plague the state.

Department of Commerce Commissioner Mike Rothman said this week that planning for the exchange has been ?going very well.?
Many observers predict that the Dayton administration will move ?full steam ahead? with implementing a state health insurance exchange program.
It?s unclear, though, whether an exchange would need legislative authorization in the near future.
U of M health care expert Larry Jacobs said Dayton could be capitalizing on the strong executive example of former Republican Gov. Tim Pawlenty to move forward with an exchange using his own authority.
?You might have found the administration to be tentative, given the lack of legislative buy-in, but that?s not the case,? Jacobs said in an interview this week. ?The Dayton administration appears to be quite comfortable moving ahead on their own power.?
Dayton used executive action in 2011 to begin planning a potential Minnesota-based health insurance exchange as one of his first acts in office. He signed an executive order to apply for a $1 million federal grant to begin planning the exchange, and under the direction of Rothman, an executive task force has been meeting to bring a plan forward by the Nov. 16 federal deadline.
So far, no Republican legislators have been involved in the administration?s exchange planning. Minnesota has received more than $20 million in federal grants to plan the exchange, according to the Kaiser Family Foundation, which has done a significant amount of research on the health care law.
The 15-member task force and about 200 stakeholders involved in several working groups, Rothman said, are trying to put together a practical blueprint for a Minnesota exchange by 2013 to avoid ?a one-size-fits-all federal solution imposed on Minnesota? in 2014.
?Minnesota has been a leader in the health care and health care industry, on the cutting edge of all these issues and we have a unique health care system in Minnesota,? Rothman said. ?The best thing is to have Minnesota develop its own exchange ? rather than have it done by the federal government.?
Many details about the exchange?? including how it would be paid for, how it would be managed, and whom it would cover ? remain unclear. The task force released broad recommendations in January 2012 for what a Minnesota exchange could look like, but so far officials have been tight-lipped about the plan?s specifics.
Jacobs noted the wide variety of stakeholders that have signed onto crafting the proposal, including business groups, unions, providers and nonprofits.
The fear of a federally imposed exchange could have inspired a number of unlikely groups, such as the Minnesota Chamber of Commerce and the Minnesota Business Partnership, to participate in discussions about the potential state-run exchange.
?They support it only because they think they?re going to get stuck with something worse, so the Chamber is in the business of cutting their losses,? said GOP Rep. Jim Abeler, chairman of the House Health and Human Services Finance Committee. ?Their support is not red hot.?
Of the three types of typical exchanges, the Chamber would prefer a private nonprofit ?that is based primarily in free-market principles,? said Kate Johansen, manager of heath and transportation policy for the business organization.
?I think we?re getting exchanges no matter what, one way or the other,? Abeler said. ?I still don?t agree that it?s necessary or a good idea.?
It appears the state is moving forward with a public-private exchange made up of publicly accountable members, according to the Department of Commerce. The plan mirrors failed legislation proposed by Democrats in the 2012 session that?s projected to cost between $40 million and $80 million to operate in 2014.
Rothman and other policy experts, however, say the potential benefits of an exchange would outweigh the costs. He said about 300,000 uninsured Minnesotans would have coverage by 2016 and that premium subsidies would help lower premiums.
?For me, it?s always been the opportunity to make a difference to help people obtain access to affordable health care,? Rothman said. ?The exchange is a strong mechanism, a strong way to help Minnesota continue to build on its health reform efforts.?
Opponents don?t view health insurance exchanges with any of that zeal.
Sen. David Hann, chairman of the Senate Health and Human Services Committee, has been a vociferous opponent of the exchanges.
He and other Republican legislators question why Minnesota, who they say is already a leader in health care, needs the new marketplace. Hann also wondered aloud where the promised savings from a health insurance exchange would come from.
?They don?t talk at all about how that?s supposed to happen,? he said. ?Sort of like, I guess by magic, that we?re going to have this thing called an exchange, and because we have it, then something magical happens and we save a lot of money.?
Hann?s committee in March voted down 7-5 an exchange bill supported by the Dayton administration.
The move prompted the governor to criticize Republicans for their ?piecemeal? approach to health insurance exchange legislation ? there was no real action over the last biennium ? and to signal his intention to continue moving forward with executive actions.
?Unfortunately, there are some who would rather play politics with this exchange in an election year than work sincerely and cooperatively to advance it in Minnesota,? Dayton wrote in a March 26 letter to Republicans. ?If the Legislature passes on enacting such legislation, which must be bi-partisan, non-ideological and constructive, we will have to utilize the legal executive actions necessary to satisfy the federal law, as has already been done in other states.?
Hann, however, counters that Dayton and his administration haven?t been forthright about the specifics of the exchange and what the federal dollars would fund.
?What is the problem that the exchange is going to solve?? Hann, also a strong opponent of the overall health care law, asked in an interview this week. ?No one has answered that question.?
The Republican from Eden Prairie hosted Dayton?s commissioners multiple times in his committee, but inquiries into the specifics of the exchange and the duties of its staff were effectively ?stonewalled,? Hann said.
Dayton is ?doing this in secret and in private, and I think it?s shameful that he?s spending millions of dollars of taxpayer money trying to change something very fundamental about people?s health care without being willing to talk about it in a public forum like a legislative hearing,? Hann said.
About 15 states have implemented exchanges, according to the National Conference of State Legislatures. Seventeen states, though, have decided against creating a state exchange or have embarked on no significant activity to initiate the process, according to the Kaiser Family Foundation.

Going forward, it?s unclear how the two opposing groups ? and some of the stakeholders in the middle ? will work together to shape a future Minnesota exchange.
DFL Rep. Tina Liebling, minority lead on the House Health and Human Services Reform Committee, said Republicans gave up an opportunity to help shape any exchange legislatively during the 2012 session because they didn?t engage in the debate.
?I think Republicans were caught between what for them was a rock and a hard place,? she said. ?On the one hand, having the federal government tell the state to do something is anathema to them, and then on the other hand being unable to pass a bill because the Tea Party members didn?t want to cooperate with the Affordable Care Act, so they had that little dilemma going on and it never got resolved.?
With strong grounds for continued ?unilateral executive action,? in Jacobs? words, the Dayton administration is likely to continue pushing forward with its own exchange ideas.
The November elections also could give Democrats an opportunity ? if they take back control of the Legislature ? to pass a bill that?s more ?consumer-friendly? and palatable to DFL interests at the expense of such stakeholders as the Minnesota Chamber of Commerce.
?I think they?re biding their time hoping that they can get a different Legislature or that they can somehow fudge it through so that they don?t have to have any legislative approval,? Abeler said. ?That seems to be what I observe.?
DFL Rep. Tom Huntley, minority lead on the House HHS Finance Committee, said he hopes to pass a health insurance exchange bill that?s in line with federal standards as one of the first acts of the 2013 session.
Lynn Blewett, an expert in the U?s School of Public Health and director of the State Health Access Data Assistance Center, said in an interview that health insurance exchanges are unlikely to affect most Americans. Those employed by large companies would continue receiving the same coverage, while about 30 million individuals likely would transfer to the exchanges by 2019.
?It?s not going to change the whole system,? she said. ?It?s like adding a new tool, a new infrastructure for people who don?t have the advantages of a large employer.?

Jeez Louise, Google's 2012 I/O opening keynote has barely begun and much of the news has already leaked out on the company's own Play Store. Add this to the list: Google is dropping the price of the HSPA+ Galaxy Nexus to $349 from $399, and is updating its flagship phone with the next, soon-to-be-unveiled version of Android, Jelly Bean. That screenshot up there should answer some of your most likely questions, but here's the short version: it'll be compatible with AT&T and T-Mobile in the US, and roughly 200 other GSM carriers everywhere else in the world (no surprise here). As for the software, well, we have enough early intel about Jelly Bean to know that's Android 4.1 running on a seven-month-old handset. As for what that jump from 4.0 to 4.1 entails, you can expect quite a few stories from us, but this official announcement should be as good a place as any to start.

Businesses should be allowed to deny health insurance to cancer patients, according to a Republican senator, because ?our nation was based on the foundation of freedom and limited government.?Discussing health care outside the Supreme Court today, Sen. Ron Johnson (R-WI) told ThinkProgress that there ?shouldn?t? be a law requiring businesses to cover employees who have cancer because that would ?create an obligation? for others. ?When you create a right for somebody,? Johnson said, ?you create an obligation for somebody else, and then you?re taking away that person?s right.?
KEYES: I know Richard Murdock had said even though businesses should give people, for instance, with cancer, health coverage, they shouldn?t be legally required by the federal government.
JOHNSON: They shouldn?t. Listen, our rights are life, liberty, and the pursuit of happiness. And when we start expanding beyond that realm, when you create a right for somebody, you create an obligation for somebody else, and then you?re taking away that person?s right. And that maybe doesn?t seem all that great, but it?s just true. Our nation was based on the foundation of freedom and limited government.

Under Obamacare, health insurance companies cannot deny people health insurance because of a pre-existing condition like cancer. Johnson remains strongly opposed to the law.
Unfortunately, he is not the first person to suggest that businesses should be permitted to deny insurance to cancer patients. Last week, Indiana Republican Senate nominee Richard Mourdock similarly argued that employers should be allowed to deny coverage to cancer patients ?if they want to keep their health care costs down.?

Ivory to ashes, tusks to dust?. Nearly 5,000 kilograms of elephant tusks and ivory carvings went up in flames on Wednesday in the west African nation of Gabon, sending a powerful message to the international community that poaching and wildlife crime will no longer be tolerated in that country.
?Gabon has a policy of zero tolerance for wildlife crime and we are putting in place the institutions and laws to ensure this policy is enforced,? President Ali Bongo said in a prepared release. In April 2011 Bongo established an antipoaching military force to protect the country?s wildlife. Earlier this month Gabon and nine other central Africa governments signed a regional plan to strengthen law enforcement and combat poaching of elephants and other wildlife species.
Elephant poaching for their valuable ivory tusks reached an all-time high in 2011 and shows no signs of slowing down. The international trade in ivory has been banned since 1989, but ivory remains popular in China, Japan and even the U.S. According to various reports, ivory can fetch $2,000 per kilogram on the black market or up to $50,000 for an entire tusk. The World Wildlife Fund (WWF) and TRAFFIC International, the wildlife trade monitoring network, estimate that between 5,000 and 12,000 elephants are poached in Africa every year for their ivory.
The burn included every tusk and piece of ivory that Gabon had confiscated from poachers and smugglers as well as the tusks of a few animals that had died of natural causes. Gabon?s ivory stockpiles were audited in March and April by the country?s parks and wildlife agencies, WWF and TRAFFIC. They counted an amazing 4,825 kilograms of confiscated ivory, which the organizations estimate came from approximately 850 elephants. Included were 1,293 pieces of rough ivory mainly (mostly whole tusks) as well as 17,730 pieces of worked ivory.
Richard Carroll, head of WWF?s Africa Program, was in Gabon to witness the event and told me the burn was ?like a huge funeral pyre? overlooking the capital city of Libreville. The ivory tusks were stacked more than four and a half meters high and were surrounded by the thousands of smaller carvings. ?The flames started gradually as they burned the wood below, then they rose up through the tusks,? Carroll reports. Armed guards from Gabon?s National Parks Agency surrounded the site to ensure that ivory remained secure during the daylong burn.
?This is a very symbolic and inspirational activity,? Carroll says. ?It shows leadership. It is a symbol that wildlife crime is being taken very seriously here.? Smaller burns of surplus or confiscated ivory have occurred in Africa?for example, Kenya burned 335 tusks a year ago?but this is the first time that a country has publicly destroyed its entire stockpile.
Kenya and several other African nations hold similar large collections of ivory, which can include confiscated ivory as well as tusks from animals that died of natural causes or during culls that are used to prevent overpopulation (no Central African countries cull their elephants). These poorly secured stockpiles often become tempting targets for criminals. Earlier this month thieves broke into a strong room at the Zambia Wildlife Authority and took off with 3,000 kilograms of ivory valued at nearly $400,000. Two men, both game scouts, have since been arrested for the crime.
?If not managed properly, ivory stockpiles in the hands of government suddenly ?get legs? and move into illegal trade,? Tom Milliken, manager of TRAFFIC?s Elephant Trade Information System, said in a prepared statement. ?Gabon?s actions effectively keep the ivory out of the way of temptation.?
Gabon had reason to worry. The audit (available in a French pdf) found that ivory recovered from poachers was scattered in 22 locations across the country. Only 62 percent of the raw ivory had been marked using TRAFFIC?s code identification system, and no central database exists to track it all. Most of it was safely stored in facilities that the auditors found to be secure, but a few days after the audit was completed, thieves stole a small stockpile in the provincial capital Oyem. No one has yet been arrested for that crime.

Gabon is home to the largest number of the animals in central Africa: 23,000 African forest elephants (Loxodonta cyclotis), about half of that species? total population. The Democratic Republic of the Congo used to hold the largest number of forest elephants, but rampant poaching over the past few years has brought the population there down below 8,000 animals. Forest elephants are smaller and rarer than African savanna elephants (Loxodonta Africana) and boast straighter tusks. Last year the Wildlife Conservation Society warned that forest elephants are rapidly running out of safe habitat, and new roads have created new entranceways that poachers can take into the forests.
Lee White, executive secretary of Gabon?s National Parks Agency, called elephant poaching an international problem. ?Gabon is coming under siege by criminal gangs of hunters and crime syndicates that smuggle ivory to Asia,? he said. ?Unless there is a strong international reaction to stop wildlife crime, and ivory smuggling in particular, the forests of Gabon will no longer vibrate with the rumble of the forest elephant.?

"The project team is delighted that the personnel sphere has successfully concluded its hydrostatic testing," said Susan Humphris, a WHOI senior scientist and the principal investigator on the upgrade project. "We look forward to receiving the sphere, integrating it into the submersible Alvin and resuming scientific research early next year."
The testing took place the Northrop Grumman hydrostatic test chamber in Annapolis, MD, and was overseen by a team comprising engineers from WHOI, Navy, ABS, and Southwest Research Institute (SwRI), the company that managed the design and construction of the titanium sphere as a subcontractor to WHOI.
During the testing, gauges were affixed to the interior and exterior of the sphere to measure strain and "creep," the minute change in the metal from prolonged stress. The sphere was filled with water and placed in a test tank of water. The tank was then pressurized in a series of test dives to progressively greater depths over four days. The team monitored 240 channels of data streaming from strain sensors to ensure the sphere stayed in the safe range of strain and creep. The sphere ultimately was tested to 8000 metersnearly 12,000 psito comply with engineering standards for human occupied submersibles and meet a factor of safety 24 percent deeper than the maximum operating depth of 6500 meters.
Sufficient data were collected and analyzed to support certification for human occupied operations to 6500 meters.
Construction of the personnel sphere is one of the biggest technical challenges in the Alvin upgrade project, which is funded by the National Science Foundation (NSF) and WHOI. The sphere needs be nearly flawlessfree of any deformities that could weaken its structure and potentially cause it to crumple under pressureand as perfectly spherical as possible.
"As the project sponsor, I am very pleased to see this state-of-the-art personnel sphere can withstand the pressure at its planned operating depth of 6500 meters," said Brian Midson, the NSF program manager for the Alvin upgrade project. "This is a critical milestone toward resuming ocean science missions with Alvin in the near future."
The new sphere is capable of descending 2000 meters deeper than the previous sphere. With greater depth comes greater pressure; therefore, the new sphere is three inches thick, rather than two. The sphere's interior diameter is 4.6 inches wider than Alvin's previous sphere, increasing the interior volume by 18 percent, from 144 to 171 cubic feet, and allowing for greater ergonomics. With five viewports, it also has improved field of view for the pilots to drive the sub and use the manipulator arms and for the scientists to help guide the pilot and make better observations of the seafloor.
To build it, engineers needed more than 34,000 pounds of titanium, about the weight of a large school bus. Two huge, barrel-shaped titanium ingots were fabricated by a mill in Morgantown, Pennsylvania, and reshaped into two giant hemispheres in Cudahy, Wisconsin. These were then shipped to Los Angeles, where workers joined the two hemispheres using a special welding technique. They also cut inserts for the hatch, electrical and fiber-optic connections, and viewports.
With testing complete, the 11,000-pound sphere will be delivered to WHOI on Thursday. Upgrades are underway on Alvin's titanium frame as well as to the research vessel Atlantis, the support ship for Alvin. Over the next several months, engineers at WHOI will reassemble the submersible and should begin dock trials in November. Alvin is scheduled to begin certification sea trials in December.
Alvin is owned by the U.S. Navy and is operated by WHOI through the U.S. National Deep Submergence Facility. The Facility provides marine scientists with access to the deep ocean with Alvin, as well as the remotely operated vehicle Jason and the autonomous underwater vehicle Sentry.
"As owner of Alvin and its supporting vessel Atlantis, the Office of Naval Research is pleased with this milestone accomplishment in the development of the new Alvin personnel sphere," said Tim Schnoor, manager of ocean research facilities at ONR.
