Court: Monroe's estate can't block photo sales

(AP) ? A federal appeals court ruled Thursday that Marilyn Monroe's estate is powerless to stop a California company from selling her images without its permission.

The 9th U.S. Circuit Court of Appeals in San Francisco ruled that The Milton Greene Archives can continue to sell iconic images of the actress without paying her estate for publicity rights. The ruling hinged on Monroe's legal residency. She owned a home in California and an apartment in New York when she died in Los Angeles in 1962.

Her estate at the time claimed Monroe was a New York resident to avoid paying California inheritance taxes. The court ruled that her estate can't now claim Monroe was a California resident to take advantage of a state law granting posthumous rights of publicity to the famous.

With the estate's active backing, the state Legislature passed the law in 2007. New York has no such law.

"Monroe's representatives took one position on Monroe's domicile at death for forty years, and then changed their position when it was to their great financial advantage," Judge Kim Wardlaw wrote for the unanimous three-judge panel.

The court, citing Forbes "Top-Earning Dead Celebrities" list, said Monroe generated $27 million in revenue, putting her third on the list.

The ruling allows the Milton Green Archives to sell images taken by its photographers without having to pay the estate royalties. Had the court determined Monroe lived in California, royalties would have been owed.

Monroe bought her California house in the Los Angeles neighborhood of Brentwood in 1962. She began filming "Something's Got to give" in April of that same year 20th Century Fox Studios lot in Los Angeles. Fox fired her two months later for repeated absences and tardiness. She was found dead in her home on Aug. 5, 1962. The court noted that Monroe maintained her New York apartment and staff during he same time period.

Her acting coach Lee Strasberg inherited 75 percent of her estate was named executor. When Strasburg died, his wife Anna Strasberg took over representing the estate. She filed a lawsuit against the California company in 2005.

Duties
Under the direct supervision of the Dean, College to Careers (C2C), develops and administers comprehensive services to provide career and academic planning and job placement services to College to Careers Cluster participants. The Director, Career Planning and Placement (C2C), will manage initiatives which assist students to prepare for internships and/or employment opportunities. This position will also identify and help sustain relationships with local businesses, non-profits and civic organizations to identify and secure internship and employment options. Assists in the coordination of job placement services for Cluster students and completers. Regularly markets, promotes and provides information for Cluster students, including website updates, event announcements, college and university events and transfer and career resources.

Participates in district-wide meetings and workshops for all individuals in Career Services positions to inform, develop district strategies, and compare, adopt and participate in best practices in processes, tools and events. Contributes to the collection, organization and analysis of information for college and district-wide planning and job placement. Develops annual plans, reports, and metrics to manage and improve career planning and placement. Assists Research and Evaluation by providing data on student career goals and job placement. Supervises and assists in the selection and hiring of Cluster staff assigned to the office. Directs staff and other meetings to accomplish objectives. Monitors staff performance. Serves as the principal liaison between the college and regional employment and manufacturing companies that can potentially provide job opportunities for CCC students.

Qualifications
Completion of a Master's Degree with coursework in Education, Human Relations, Psychology, or Human Services, supplemented by three years' experience supporting clients in a business or higher education environment or supplemented by six years' of related experience in a business or community organization.

Demonstrated ability to build and sustain relationships and establish partnerships; especially with academic, business or community organizations. Additional experience in higher education preferred. Demonstrated ability to work with a wide range of stakeholders. Ability to think strategically and to identify opportunities, converting them to alternatives for students; and?to quickly analyze regional employment trends.

Mitt Romney: 'The time has come to turn the page'

TAMPA?Mitt Romney accepted the Republican presidential nomination by making an appeal to Americans disappointed in President Barack Obama's tenure in the White House, arguing he can usher in the change Obama promised in 2008 but has failed to deliver.

"Tonight I'd ask a simple question: If you felt that excitement when you voted for Barack Obama, shouldn't you feel that way now that he's President Obama?" Romney said. "You know there's something wrong with the kind of job he's done as president when the best feeling you had, was the day you voted for him."

He said Americans "deserved" the "hope and change" that Obama had promised, but because he has failed to keep his promises, he doesn't deserve a second term.

"This president can ask us to be patient. This president can tell us it was someone else's fault. This president can tell us that the next four years he'll get it right," Romney said. "But this president cannot tell us that you are better off today than when he took office. America has been patient. Americans have supported this president in good faith. But today, the time has come to turn the page."

Romney told voters it's time to "put the disappointments of the last four years behind us" and "forget about what might have been and look ahead to what can be."

"Many Americans have given up on this president but they haven't ever thought about giving up. Not on themselves. Not on each other. And not on America," Romney said. "What is needed in our country today is not complicated or profound. It doesn't take a special government commission to tell us what America needs. What America needs is jobs. Lots of jobs."

Romney's speech was a bookend to speeches he's given in the 18 months since he launched his second bid for the presidency. But unlike other remarks, Romney spoke at length about his life and his family?telling voters about the "unconditional love" he received from his parents and has tried to pass on to his own kids and grand kids.

"All the laws and legislation in the world will never heal this world like the loving hearts and arms of mothers and fathers," Romney said. "If every child could drift to sleep feeling wrapped in the love of their family--and God's love--this world would be a far more gentle and better place."

Romney's remarks were aimed at humanizing him with voters, who have been openly skeptical of his candidacy. Before he took the stage, aides sought to tell a different story about Romney by having those who know him speak. Friends of the candidate spoke about his Mormon faith and others, including the founder of Staples--the office supply chain that was started with seed money from Bain Capital, a firm Romney founded--attested to his time as a venture capitalist.

But Romney's speech was somewhat overshadowed by a rambling appearance by the actor and director Clint Eastwood, who ad-libbed a skit featuring him speaking to an invisible Obama on the stage. Romney aides had expected Eastwood, who endorsed the candidate last month, to make a short 5-minute speech; they looked anxious as the Hollywood actor's remarks extended past the 10-minute mark.

But Romney won the audience's attention a few minutes later, as he made an entrance from the back of the convention floor, walking through the delegates who excitedly shook his hand. On stage, a singer sang an acoustic version of "Born Free," the Kid Rock song that has become Romney's anthem.

In his speech, Romney repeated the argument he has made against an Obama second term?insisting the president has simply not turned things around. He repeatedly emphasized that his focus would be on creating jobs?reiterating that adding employment hasn't been Obama's focus.

"President Obama promised to slow the rise of the oceans and to heal the planet," Romney said, a line that prompted laughter on the RNC floor. "My promise is to help you and your family."

If elected, Romney vowed to "unleash an economy that will put Americans back to work" and restore "the America we want for our children."

"That future is our destiny. That future is out there. It is waiting for us. Our children deserve it, our nation depends upon it, the peace and freedom of the world require it. And with your help we will deliver it," Romney said. "Let us begin that future together tonight."

My Number Problem: ?Stupid Scale? | Get Fit! Stay Sexy! Live Healthy!

Until this year, I was obsessed with numbers?those terrible numbers on the scale.

When I was in high school, I didn?t care what I looked like as long as the scale said 125 lb or lower. ?I was satisfied with the number not even concerned about my health.

Small Number on Scale = Healthy?. right?!

It wasn?t until I started training and competing for fitness bikini competitions that I learned how to not rely on the scale but more on body fat and body composition. ? The scale is really close to being the devil?s gift to the health & fitness world in my book because people are so fixated on the numbers. ?I have had so many clients not even realize that they were losing inches and body fat because the scale did not show the results they wanted.

2005: 16 years old. ?128 lbs. ?Size 9. 24% Body Fat

2012: 23 years old. ?135 lbs. ?Size 5. ? 16% Body Fat

So, does muscle weigh more than fat? ?Nope, because 5 lbs is 5 lbs. ?Is muscle more dense than fat? ?Yes! ?

What does that mean? ?It means that if you had a cup of fat and a cup of muscle, the muscle would weight more. ?Per volume (size) muscle is heavier.? As you can see from the pictures above, I was bigger at 128 lbs than I am now at 135 lbs!!! I love being heavier!

My advice to you:

  1. ?Get off the SCALE! ? Focus on being healthier, stronger, fitter, and/or increase your cardiovascular shape.
  2. If possible, get your body fat tested. ? I suggest using the skin fold testing method, Bod Pod, DEXA, or Hydrostatic Weighing. ? Read more about different testing methods and the accuracy here with Georgia State University.
  3. Increase lean muscle. ?WARNING: ?Burning fat and increasing lean muscle mass may cause you to gain weight. ?However you will have a sexy, sculpted body, with little fat covering those awesome abs.
  4. Don?t weigh yourself every day or every 3 days. ? Weigh at the same time, same day, every week. ? It will help your mental health (women go crazy over the scale ###) and it gives your body time to change. ?Change does not occur over night!

Same dress but I had to take 4 inches of the waist of the dress for the WBFF competition. I remember not being about to sit at prom because it was too tight!

Start with small goals to achieve BIG dreams! ? It?s not the number on the scale that is important. ? What is important is if you reduce the risk of chronic diseases, obesity, and other health issues because you are consistent with physical activity and eating a healthy diet!

Star Trek-like tricorder set for test in space

A portable medical device that echoes the tricorder handheld analytical tools used in the sci-fi series Star Trek is headed to the International Space Station, the?Canadian Space Agency recently announced.

The device, called Microflow, offers near real-time analysis of body fluids for everything from infections and stress to cancer.

The portable box uses fiber optic technology to detect and analyze cells and biological molecules as they flow by a laser beam. Various detectors are?positioned where the stream meets the laser. Diagnosis takes about 10 minutes, the space agency explains.

Canadian astronaut Chris Hadfield will take 22-pound, toaster-sized Microflow to the International Space Station in December. The six-month test will determine the feasibility of such devices for long-duration spaceflight.

While Trek fans will need to wait a little longer before they have a true replica tricorder in their hands to analyze everything, researchers are hard at work at tricorder-inspired gadgets.

Med Sensation, for example, is working on a ?Glove Tricorder? fitted with sensors that will allow doctors to?maintain their human touch while performing medical exams with the latest technologies. The video clip below describes how it works.

And with other devices such as Peter Jansen?s open-source tricorder we wrote about earlier this year under development, the day when sci-fi meets reality appears to be getting closer.

Burn Notice: Mustard Species's Specialized Spices Keep Local Bugs at Bay

When you pass the Grey Poupon, you're probably not thinking about nature's defense systems. But mustard's kick is not just for seasoning your sandwich, it's a plant's way of biting back. Recent research has found one reason why certain mustard plants carry these chemical compounds: in some environments a spicy taste may deter pests.

Molecular and field biologists from Duke University, the Max Planck Institute for Chemical Ecology in Germany and the University of Illinois at Urbana?Champaign have investigated why two populations of mustard plants from the same species produce distinctly different spicy flavors. They detail their findings in the August 30 issue of Science.

The researchers studied the plant species Boechera stricta, a member of the mustard family. They looked at two populations of B. stricta growing in the Rocky Mountains, one in Montana and another in Colorado. Each population tastes spicy but in a slightly different way, suggesting a regionally distinct chemical composition.

The researchers selected these populations for their pristine natural environment, habitats that have seen little change in 3,000 years. Co-author and Duke University evolutionary geneticist Thomas Mitchell-Olds explains that this kind of environment allows biologists to answer questions about a species's evolution. In this case, it allowed the scientists to both consider the genetic variation of mustard plants and consider the still extant environmental factors that pushed this variation.

The researchers first analyzed specimens from the Colorado and Montana populations in the lab. They identified the chemical compounds that produced the differing mustard plants' spicy flavor. They also discovered how the plants produced these chemicals. Through careful molecular analysis, they pinpointed a single gene, BCMA, that encodes for an enzyme's activity. This enzyme is responsible for beginning the production of the compounds that give each variety of mustard its distinctive taste. Depending on the variant of the BCMA gene, the enzymes will produce the distinct flavor of either a Montana or Colorado mustard plant.

With the chemical and genetic differences identified, Mitchell-Olds and colleagues next went into the field to see how these plants survived in their respective habitats. The researchers planted thousands of Colorado and Montana mustard plants together on field sites in each state. They returned in the spring to count the leaves of each plant and quantify the damage done by hungry insects. As expected, the Colorado and Montana plants produced their distinctive Colorado and Montana spices, regardless of location. What was more intriguing, however, was the way insect populations responded to each.

Montana insects stayed away from Montana plants but devoured the Colorado variety. Their aversion suggests that the Montana mustard's spice is specially formulated to deter local pests. It's possible therefore that many generations ago, a mutation on the BCMA gene created a family of plants with the Montana spice that so successfully deflected bugs that this gene became common in the population.

The Colorado site told a slightly different story. These bugs had a less discerning palate, consuming the local and foreign mustards with similar gusto. The researchers need to investigate further to understand this difference, but they did observe that certain related plants fared better than others, suggesting that there are other heritable defense traits that serve in the Colorado environment as well. It is also possible that the difference reveals something about the Colorado insect population, such as a high spice tolerance. It could also suggest that the environment is more competitive, and ravenous pests must stomach a spice-induced tummy ache or face starvation.

(AP) ? The U.N. nuclear agency has created a special Iran Task Force of nuclear weapons experts, intelligence analysts and other specialists focused on probing allegations that Tehran has been ? or is ? secretly working on developing atomic arms, according to an internal document shared with The Associated Press.

The announcement from the International Atomic Energy Agency says the elite squad started work Aug. 10. Dated Wednesday, the International Atomic Energy Agency statement says the unit will concentrate on implementing IAEA agreements with Iran, allowing it to monitor its nuclear activities as mandated by the Nuclear Nonproliferation Treaty.

It also says it will focus on "relevant" IAEA and U.N Security Council resolutions on Iran. Both have demanded that Tehran stop activities that could be used to make nuclear weapons and cooperate with the agency's investigation of suspicions Tehran worked on nuclear weapons.

But while drawing together its best experts, the new task force will have no more power regarding inspections of Iran's known or suspected nuclear sites than previous IAEA inspectors did.

Agency attempts to visit a site at Iran's Parchin military complex southeast of Tehran have documented IAEA limitations. For months, satellite images have recorded what the International Atomic Energy Agency suspects is an attempt to sanitize the site of suspected work on explosive charges used to detonate a warhead. At the same time, Iran has repeatedly rebuffed agency efforts for access ? including last Friday.

The most recent satellite images now show what diplomats last week said appears to be pink material shrouding buildings apparently linked to the alleged experiments, effectively blinding agency attempts to monitor a site that they have been kept from visiting. The diplomats demanded anonymity because they were not authorized to comment on the IAEA's Iran investigation.

Iran says such allegations are based on evidence fabricated by the United States and Israel and insists its nuclear program is meant only for making reactor fuel, medical isotopes and peaceful research. But it refuses to give up uranium enrichment, which can produce both reactor fuel and the core of nuclear warheads, despite offers of fuel from abroad. And it has stonewalled an IAEA probe into its alleged weapons work for more than four years, increasing concerns that it has something to hide.

Creating a unit focused on only one country is an unusual move for the IAEA, reflecting the urgency the U.N. nuclear watchdog is attaching to Iran amid fears that it is moving closer to the ability to make nuclear weapons, despite its denial. With diplomatic efforts to engage Tehran on its nuclear activities stalemated ? and Israel warning that it will not tolerate an Iran armed with atomic arms ? concerns are growing that time is running short to defuse tensions peacefully

Israel is particularly worried about a fortified bunker at Fordo, where Iran has begun producing uranium enriched to a level closer to the grade used in nuclear weapons than its main stockpile of fuel-grade material. About 70 kilometers (40 miles) south of Tehran, Fordo has about 800 centrifuges operating so far, enriching to a 20-percent level, and continues assembling others without operating them ? diplomats say that close to 3,000 are now fully or partially screwed together, including hundreds over the past three months

In Tehran, Iran's IAEA envoy, Ali Asghar Soltanieh, told reporters Tuesday that his country will "not suspend enrichment activities, even for a second."

Diplomats had told the AP last week that the IAEA was forming a special Iran team. The announcement confirming that information was forwarded Wednesday by a diplomat who demanded anonymity because he was not authorized to share confidential and internal IAEA documents. A phone call seeking comment from Soltanieh went to his voice mail.

Instead of focusing only one country, agency experts up to now have been tasked with following dozens of nations as they look for signs indicating secret attempts to make nuclear weapons.

Some IAEA officials feel that means that they often spend an inordinate amount of time monitoring countries that are unlikely to engage in such activities ? Western European nations, for instance ? meaning that not enough attention is paid to potential proliferators.

One of the diplomats who spoke to the AP last week said the Iran team will be comprised of about 20 experts drawn from the main IAEA pool.

The IAEA announcement said the squad will be headed by Massimo Aparo. A nuclear engineer, Aparo is an IAEA veteran who has held numerous senior positions linked to nonproliferation within and outside of the IAEA.

The agency said he will be reporting to IAEA Deputy Director General Herman Nackaerts, the head of the agency's nuclear inspectors and the agency's point man on Iran.

This article discusses the specific sub-field of digital forensics and the types of crimes that would need digital forensics for an investigation.

Digital Forensics

This sub-field of forensics examines data and information from computer storage media so that it may be used as evidence in a court of law or to answer a specific legal question as it may need.

For example in private investigations, digital forensics investigator may use digital forensics at the request of a private attorney for a defendant in a public case. And evidence may be gathered to prove that an employee is using company resources for personal private business use such as selling goods online or visiting the site that is against the company rules and regulation about Information technology. In this case, the employee may be subject to disciplinary action by the company, more personal liability, and perhaps criminal liability.

More so, evidence that proves an employee has violated an employment agreement. For example, evidence may be gathered that proves an employee accessed records or other information without authorization. It may also give that one employee has harassed another employee or perhaps stolen company information.

While public investigations require digital forensics only when a crime has been committed and computers can be used in crimes in one of the following ways, such as, Crimes associated with the prevalence of computers i.e. copyright violations, crimes in which computer is the instrument of the crime or crime in which computer are incidental to another crime such as using it to store illegal records and crimes in which the computer is the target such as crimes that involve stealing information from a computer or denial of service crimes.

Digital Evidence Collection

The collection of digital evidence may have several prominent roles in collection. These roles may include:

?Physical Technology Collection:

Investigators will collect the physical media. Physical media is any technology that stores data or information. E.g. hard disks, PDAs, flash and other electronic devices.

?Physical Media Analysis:

Investigators will analyze the physical evidence for finger prints or other evidence found on the surfaces of the physical technology. This role requires a deep understanding of the technology and may be able to aid the roles of digital evidence collection and digital evidence analysis even when the physical device is severely damaged.

?Digital Evidence Collection:

Investigators will collect the digital data from the physical device. Here, the evidence is the full set of files, folders, and bits stored on the physical media.

?Digital Evidence Analysis:

Investigators will analyze the data collected. Analysis of digital evidence may show hidden information.

Digital Evidence

Digital evidence is both the full set of bits, bytes, and blocks retrieved from the technology. It is also any subset of that full set such as e-mail, log files, text documents, spreadsheets, and other files.

Digital evidence has several unique challenges and questions that must be addressed. The highest challenge is found in modern computers which are implanted as multi-user systems with potentially hundreds of users. Since evidence must conclusively show facts in an investigation, it becomes critical to clear up ambiguities of who owns the data, how the data came to be on the system, and who or what originated the data.

Another concern is the legal issues surrounding the collection of evidence from privately owned devices such as cell phones in private investigations as well the expectation of privacy for employees using company provided resources. While no clear answers have emerged, many businesses specify the proper use of their assets and need employees to waive any such rights to privacy on company assets as part of their employment contract.

Furthermore, this issue has recently become more complicated with the onset of free publicly available encryption technologies. This specific question is whether or not a user retains an expectation of privacy by using encryption on company assets. Clearly, the company has the right to the encrypted version of the data; but does the company have the right to mandate the employee offer an unencrypted version? Subsequently, can a person be ordered by a court of law to give a password to law enforcement to decrypt the digital evidence?

One may be tempted to argue that no digital bit has ever been seen, so plain sight is not possible and not an issue. This issue of privacy raises the question of ?plain sight? while collecting evidence from digital sources. Others may argue that a permit to collect any digital evidence stored on a disk or computer device is enough to collect any and all evidence from a computer for any crime.

The plain sight doctrine is best interpreted conservatively so that any seizure of evidence of one crime revealed during the search for evidence for another crime should be then justified by a permit.

Twitter as you've never tasted it before

Whether it?s the rise and proliferation of infographics from media buzzword to bestselling book, or the first Data Journalism Awards this year, data visualisation now pervades almost all disciplines, employed and celebrated as a means of conveying information effectively.

It came as no surprise, then, that the topic was turned on its head at this year?s Campus Party Europe in Berlin, Germany. Billed as ?the biggest electronic entertainment event in the world?, the festival is a week of tech-related talks and workshops with 10,000 participants - in the words of keynote speaker, World Wide Web inventor Tim Berners Lee, ?a hackathon gone big?.

On Wednesday last week, a trio from the Copenhagen Institute of Interactive Design (CIID) in Denmark demonstrated their Tasty Tweets project. According to students Kat Zorina, Ruben van der Vleuten and Kostantinos Frantzis, data visualisation is all well and good, but some of it is - quite frankly - boring. ?Some infographics are practical but don?t really trigger action,? said van der Vleuten. ?We wanted to move away from these conventions and take a more tangible approach?.

The Tasty Tweets software scans Twitter 100 tweets at a time, searching for mentions of specific fruit names - tonight it was apple, orange, pineapple and cranberry. The proportions of each are used to trigger valves in vessels containing the corresponding fruit juices. The resulting Twitter smoothie collects in a glass below as a gustatory representation of the initial data.

The CIID team envision developing their project to be applied to the quantified self movement, which strives for ?self knowledge through numbers?, by generating drinks based on individuals? nutritional requirements at any given time. An audience member, however, had other ideas - namely a bar that facilitates truly social drinking by creating beverages based on guests? online interactions.

Twitter may taste fruity for now but what does it sound like? I found out on Saturday, when British duo Daniel Jones and Peter Gregson presented The Listening Machine - an automated online system that generates wholly digitally native compositions based on Twitter activity.

Like their contemporaries at CIID, Jones, a music artist and programmer,and Gregson, a cellist and composer, wanted to overcome the static nature of traditional data visualisation and were keen to add flow and a human element by incorporating sound. They noticed that Twitter data is often referred to in a similar way to music, with words like ?orchestration? and ?volume? constantly overlapping.

?Music can be used to more accurately represent digital human interactions and reflect the dynamics of conversations.? Gregson explained. To avoid dealing with the sheer mass of data generated by Twitter, they draw from a selection of 500 users involved in a spectrum of social life. Sponsored by the BBC for multimedia platform The Space, the topics covered correspond with the BBC?s own categories, with 10 per cent of users each involved in sports, technology, arts, politics, health, business and science, and the remaining 20 per cent selected at random. These 500 tweeters are followed throughout the six-month project and remain unaware of their participation.

The Listening Machine gauges the sentiment of tweets, and their rate and subject matter. Scanning for emoticons and adjectives, the sentiment is translated into major, minor and modal chords depending on whether the mood is happy, sad or neutral respectively.? The rate of tweets determines the tempo of the composition, and the topics themselves also have a specific sound. The rhythm of the music is dictated by the rhythm of tweeted sentences.

The artists mapped the vowel sounds of the English langauge's 1000 most used words onto musical phrases, which were then painstakingly played by musical ensemble Britten Sinfonia?s instruments. ?We had a room full of accomplished musicians playing ridiculously easy music. People started to make mistakes through sheer boredom.? laughed Gregson.

Launched in May, The Listening Machine was built in six weeks straight, but like the tweets it captures, it has a short life, coming to an end on 31 October. However, Jones and Gregson plan to go on tour with the orchestra, who will play live to a score generated on-screen, potentially bringing in an added dimension to the work by using a sample of location-specific Twitter accounts for every tour date.

Think back to two moments from the 2005 NFL Draft: Cedric Benson?s tearful outburst when he was chosen No. 4 pick overall by the Chicago Bears, and Aaron Rodgers sitting in the green room for hours, waiting to hear his name called.

Rodgers did not cry, or at least ESPN did not capture any tears in what had to be a difficult moment. But good things come to those who wait, and Green Bay selecting Rodgers 24th overall was a blessing in disguise.

Seven years later, Rodgers and Benson unite for what will likely be the starting backfield in Green Bay?s offense.

Their first game together last Thursday night in Cincinnati was successful, with Benson carrying the ball six times for 38 yards. However, the Packers? leading rusher was actually Rodgers with six carries for 52 yards and a pair of touchdowns on scrambles.

When Rodgers recently said the Packers need to show they can run the ball, it is unlikely he had himself in mind. His stance has taken on a much different tone from July when he replied ?Do we need to?? when asked about being able to run the ball.

His initial response was the right one. After one of the most prolific offensive seasons in NFL history, why would you start delegating to a player with a checkered past like Benson? Coach Mike McCarthy has history and great results on his side to avoid just that.

Green Bay?s unique QB-driven offense
Quarterbacks want the ball in their hands, and McCarthy puts the ball in Rodgers? hands often.

Rodgers averages 39.4 drop backs per start (passes, sacks and runs), which is the second highest average in NFL history (min. 60 starts). As shown in Table 1, only Daunte Culpepper has averaged more.

Brett Favre averaged 38.6 drop backs per start in two seasons under McCarthy (2006-07). Running this type of offense in Vince Lombardi's era would have been blasphemy, but football has evolved dramatically.

Packers don?t need no stinkin? run game
The Packers' rushing issues the last four season aren't a secret. But does this matter in today?s NFL?

If you have an elite quarterback, you can consistently win without a running game. Whether it?s rushing for under 100 yards or not exceeding 30 carries, the teams with the very best quarterbacks are the ones that still win those types of games.

Of course, what separates Rodgers from the other elite quarterbacks is the way he takes matters into his own hands in the running game, scrambling for yards to inflate his team?s rushing statistics. That is why it?s good to remove quarterback carries from a team?s rushing stats to get a better sense of their intended ground game (handoffs only).

When you remove Rodgers from the stats, the results of Green Bay?s rushing offense are not pretty. In his 68 career starts (including playoffs), the Packers only average 21.9 carries for 88.2 yards (4.02 yards per carry). In spite of the running game, their record is 45-23 (.662).

In fact, no matter what Green Bay does on the ground, Rodgers usually plays at a high level, as seen in Table 2.

When Green Bay rushed for a season-high 138 yards against Oakland last year, it was the first game all season where Rodgers did not have a passer rating over 100.0. It was also the first time he did not complete at least 60 percent of his passes. Rodgers was 17 of 30 (56.7 percent) with a 96.7 passer rating.

So much for the ?running game opening up the passing game? theory.

If the Packers fail to even average 3.0 YPC (13 games), Rodgers still has a 103.6 passer rating. When they average over 5.0 YPC (11 games), which is supposed to signify great rushing, Rodgers has a 100.8 passer rating.

See the big picture? No matter what Green Bay does on the ground, the Packers win and lose depending on Rodgers and the defense. His passing performances are still usually great and independent of their rushing ability.

Initial evidence points to the running game and passing game being independent of each other. If an offense wants to be one-dimensional, it can be successful as long as they have the right talent and mindset for it like Green Bay.

Why do you think many of the best running backs ? such as Adrian Peterson, Maurice Jones-Drew, and Chris Johnson ? have been on some of the worst offenses in the league in recent years?

Likewise, we keep seeing teams excel in the passing game without any real threat of the run, such as the Super Bowl champion New York Giants. The Packers have been doing it for years under McCarthy.
